Introduction

1. Introduction

Welcome to AOMO Travel. These Terms and Conditions (“Agreement”) outline the rules, responsibilities, and obligations between you, the customer (“Customer,” “You,” or “Your”), and us, AOMO Travel (“Company,” “we,” “our,” or “us”). By accessing or using our website, mobile application, or services, you agree to comply with and be bound by these terms. Please read this Agreement carefully, as it affects your rights and obligations. If you do not agree with these terms, please refrain from using our services.

Our services include the provision of travel-related services such as flight bookings, accommodation reservations, car rentals, tour packages, cruises, and activities. This Agreement governs all bookings made through us, whether through our website, mobile application, phone, or in person.

2. Definitions

  1. Company/We/Us: Refers to AOMO Travel, the entity providing travel-related services.

  2. Customer/You/Your: The person or persons who book travel arrangements with us.

  3. Services: The travel arrangements and services offered by the Company, including transportation, accommodation, tours, and other related services.

  4. Suppliers: Third-party providers of travel services, such as airlines, hotels, tour operators, car rental companies, and other service providers.

 

3. Booking Terms

3.1.  Booking Procedure

You can make bookings through our website, mobile application, or by contacting our customer service team. A booking is confirmed once full or partial payment has been received, and you receive a booking confirmation from us via email or other communication channels. It is your responsibility to check the details of the confirmation and notify us of any discrepancies immediately.

3.2.  Booking on Behalf of Others

If you are booking on behalf of other travellers, you confirm that you have the authority to act on behalf of those individuals and agree to take responsibility for all obligations under this Agreement. You must ensure that all information provided, including names and contact details, is accurate.

3.3.  Payment Terms

For all bookings, a 30% deposit is required to secure the reservation. The amount of the deposit may vary depending on the type of booking. Full payment is typically required 1 day prior to the Tour start date unless otherwise stated. Failure to make timely payments may result in the cancellation of your booking and forfeiture of any deposits or payments already made.

We accept various forms of payment, including credit cards, bank transfers, and other approved payment methods. All transactions are processed securely, and we take reasonable steps to ensure the protection of your financial information. Please note that currency conversion fees may apply for international transactions.

3.4.  Pricing

All prices listed on the DealsAway.com website include taxes, charges and service fees, including GST, where applicable. Prices for our services are displayed in AUD (Australian dollars) and are subject to change without notice. Price changes may occur due to variations in currency exchange rates, government taxes, fuel surcharges, or changes in supplier rates. If there is an increase in the price of your booking, we will notify you as soon as possible, and you will have the option to accept the price increase or cancel your booking for a full refund.

In some cases, promotional or discounted prices may be available. Such prices may carry additional terms and conditions, and once booked, they may not be amended or canceled.

4. Cancellation and Amendments

 

4.1. Cancellation by the Customer

You may cancel your booking at any time by providing written notice to us. However, cancellation charges will apply depending on the time before departure. The cancellation fees vary depending on the service type, destination, and supplier policies, and are generally as follows:

  1. More than 15 days before departure: Full refund.

  2. Less than 15 days before departure: 80% refund of the total cost.

 

Some bookings, such as flights, special event tickets, or non-refundable hotel rooms, may have specific cancellation terms that differ from the general terms above. Please check your specific booking details for applicable terms.

4.2. Changes by the Customer

If you wish to make changes to your booking (e.g., change travel dates, add services, or amend participant details), you must notify us as soon as possible. We will endeavor to accommodate changes, but availability and additional charges may apply. We cannot guarantee that requested changes will be possible.

For changes related to flights, hotels, or other third-party services, the supplier’s terms and conditions will apply, and additional charges may be imposed by them.

4.3. Cancellation by the Company

We reserve the right to cancel your booking under exceptional circumstances. This may include, but is not limited to, force majeure events such as natural disasters, political instability, strikes, or other events beyond our control. In such cases, we will provide alternative arrangements where possible or offer a full refund if no alternative can be arranged.

4.4. Supplier Changes and Cancellations

Third-party suppliers, such as airlines, hotels, and tour operators, may occasionally make changes to your booking, including schedule adjustments, route changes, or cancellations. We will inform you of any significant changes as soon as possible and work to minimize any disruptions to your travel plans.

5. Refund Policy

Refunds will be processed in accordance with the cancellation terms outlined in this Agreement. Refunds may take up to 7 business days to process, depending on the payment method and any third-party suppliers involved. Refunds will be issued using the original form of payment unless otherwise agreed upon.

In cases where partial payments have been made, any refundable amounts will be calculated based on the total cost of the booking minus any applicable cancellation fees.

No refunds will be provided for unused services, including flights, accommodations, tours, or other pre-booked activities that were missed due to personal reasons, illness, or changes in personal circumstances.

6. Travel Documentation and Requirements

 

6.1. Passports and Visas

It is your responsibility to ensure that you possess valid travel documents, including passports and visas, for all destinations included in your booking. Your passport must have at least 6 months of validity remaining beyond your intended return date. Failure to obtain the necessary documents may result in denied boarding or entry into a country, and the Company will not be liable for any associated costs or losses.

6.2. Health and Vaccination Requirements

You must be aware of and comply with any health requirements, including vaccinations and medical clearances, for the destinations to which you are traveling. It is recommended that you consult with your doctor or a travel clinic well in advance of your trip to ensure you meet all necessary health requirements.

We are not liable for any medical issues that may arise during your trip, nor are we responsible for any losses due to insufficient health documentation, including vaccination certificates or negative COVID-19 tests, where applicable.

6.3. Travel Insurance

We strongly recommend that all travelers purchase comprehensive travel insurance. This should cover trip cancellations, interruptions, medical emergencies, loss of luggage, and other unforeseen circumstances. The Company is not responsible for any financial losses incurred due to a lack of travel insurance.

You are responsible for reviewing your travel insurance policy and ensuring that it provides adequate coverage for your needs. Some suppliers may require proof of insurance before confirming your booking.

7. Special Assistance and Accessibility

 

7.1. Special Requests

If you require special assistance or have specific needs related to mobility, dietary restrictions, medical conditions, or other requirements, you must inform us at the time of booking. While we will make every effort to accommodate such requests, we cannot guarantee that all services will be able to meet your needs. It is essential that you verify the availability of appropriate accommodations before completing your booking.

7.2. Accessibility

We endeavor to provide accurate information regarding the accessibility of the accommodations, transportation, and activities we offer. However, local standards may differ from those in your home country, and the level of accessibility may vary depending on the destination. It is your responsibility to review all accessibility information provided and make any necessary arrangements to ensure that your travel needs are met.

 

8. Customer Conduct and Responsibilities

 

8.1. General Conduct

As a customer, you agree to conduct yourself in a respectful and responsible manner throughout the duration of your trip. You are expected to comply with all local laws, respect local customs and traditions, and adhere to any rules or regulations set by the suppliers of services, such as hotels, tour operators, or transport companies.

If you engage in inappropriate, abusive, or dangerous behavior that negatively impacts other travelers or service providers, we reserve the right to terminate your participation in the trip without refund or compensation.

8.2. Responsibility for Minors

If you are traveling with minors (under the age of 18), you are responsible for their safety, behavior, and compliance with these terms and conditions. Any travel arrangements made for minors must be in compliance with applicable laws, including child travel consent forms and guardianship documents if necessary.

 

9. Supplier Terms and Conditions

 

9.1. Third-Party Suppliers

Our services may include travel arrangements made with third-party suppliers, such as airlines, cruise lines, hotels, car rental companies, and tour operators. Each supplier has its own terms and conditions, which will apply in addition to those outlined in this Agreement. By making a booking through us, you agree to comply with all applicable supplier terms.

We act as an intermediary between you and the supplier, and while we strive to work with reliable and reputable partners, we are not liable for any failure or shortcomings in the services provided by third-party suppliers.

9.2. Flights

Flight schedules and routes are subject to change by airlines, often without prior notice. We recommend that you reconfirm flight times and check-in details with the airline 24-48 hours prior to departure. We are not responsible for any changes in flight schedules, cancellations, or missed connections. Any changes to your flight itinerary must be made directly with the airline.

In cases of overbooking, delays, or cancellations, the airline’s terms and conditions will apply, and compensation or alternative arrangements will be provided at the airline’s discretion.

9.3. Accommodations

Accommodation bookings are subject to the policies of the individual hotel or property. Check-in and check-out times, cancellation policies, and specific room requests are governed by the accommodation provider. We cannot guarantee that all special requests, such as room location, bed type, or accessibility features, will be met.

10. Force Majeure

We shall not be liable for any failure to perform our obligations under this Agreement due to circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather conditions, acts of terrorism, civil unrest, government actions, strikes, or pandemics.

In the event of force majeure, we will make reasonable efforts to offer alternative travel arrangements. However, refunds or compensation may not be available in such cases.

11. Dispute Resolution

 

11.1. Complaints

If you encounter any issues during your trip, you must first notify the relevant service provider (e.g., hotel, tour operator) to resolve the problem on the spot. If the issue is not resolved, please contact our customer service team immediately. We will make every effort to address your concerns promptly and fairly.

11.2. Mediation and Arbitration

In the event of a dispute that cannot be resolved through direct communication, the parties agree to submit the matter to mediation or arbitration in accordance with the laws of Heilongjiang, China. The costs of mediation or arbitration shall be shared equally by both parties, and any decision reached will be binding.

11.3. Jurisdiction

This Agreement is governed by the laws of Heilongjiang, China, and any legal action must be filed within the jurisdiction of the courts of Heilongjiang, China.

12. Privacy Policy

 

Your privacy is important to us. We are committed to protecting your personal information in accordance with applicable data protection laws. Our Privacy Policy Link outlines how we collect, use, and store your data. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

13. Intellectual Property

 

All content on our website, including but not limited to text, graphics, logos, images, and software, is the intellectual property of AOMO Travel or our suppliers. You may not reproduce, modify, or distribute any content without our express written permission.

14. Amendments to Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time. Changes will be posted on our website, and continued use of our services after such changes have been made constitutes acceptance of the revised terms.

15. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

No failure, delay, relaxation or indulgence by a party in exercising any power or right conferred upon it under these terms and conditions will operate as a waiver of that power or right. No single or partial exercise of any power or right precludes any other or future exercise of it, or the exercise of any other power or right under these terms and conditions.

16. Entire Agreement

This Agreement constitutes the entire understanding between the parties regarding the subject matter herein and supersedes any prior agreements, representations, or discussions. Any changes to this Agreement must be made in writing and signed by both parties.

17. Acknowledgement

You acknowledge that you are 18 years of age or older and that you understand and agree with the above terms and conditions, our Privacy Policy and any other policies provided on the DealsAway.com website at the time of booking or during the booking process.
